Terms of Service

The rules that govern how artistes, partners, and visitors engage with WBMPAF's digital properties.

1. Acceptance of Terms

By accessing or using any WBMPAF digital properties—including our website, mobile interfaces, member portal, casting portal, or any Meta-connected profile—you agree to comply with these Terms of Service and all applicable Indian laws, including the Trade Union Act, 1926.

If you do not agree with any part of these terms, please stop using our services and contact us for assistance through offline or alternative channels.

2. Eligibility & Account Security

  • Access to restricted portals is limited to verified artistes, active members, and authorized production partners.
  • You must protect your login credentials and notify WBMPAF immediately of any unauthorized access or suspected compromise.
  • WBMPAF may suspend or terminate accounts if dues are unpaid, membership eligibility changes, or if you violate these terms, our code of conduct, or applicable laws.

3. Acceptable Use

Content

  • All uploaded content (photos, reels, showreels, portfolios) must be your own or properly licensed.
  • Uploading defamatory, abusive, hateful, obscene, misleading, or illegal material is prohibited.
  • AI-generated impersonations or content that misrepresents identity is not allowed.

Security & Platform Integrity

  • Scraping, data extraction, reverse engineering, or security testing of WBMPAF systems is prohibited without written authorization.
  • Any attempt to interfere with system operations or bypass access controls will result in immediate termination and potential legal action.

Respect for Other Artistes

  • Do not share another member’s contact information or personal details without their explicit consent.
  • Casting data or directory information must not be misused for unsolicited outreach, spamming, or commercial exploitation.

4. Payments & Refunds

  • Membership fees, welfare contributions, and casting portal subscriptions are billed in Indian Rupees (INR).
  • Payments made through UPI, bank transfer, or card are non-refundable, except in cases of confirmed duplicate charges.
  • Validated refunds (if applicable) will be processed within 10 working days, with applicable bank or gateway charges deducted.

5. Intellectual Property

All content published by WBMPAF—including the website, design, logos, union insignia, and curated digital assets—is the exclusive property of WBMPAF.

Artistes retain ownership of all content they upload but grant WBMPAF a limited, non-exclusive, royalty-free license to:

  • Host, store, and display content
  • Use selected material for union objectives, promotional showcases, or public communication

This license can be revoked by requesting deletion of the underlying content, subject to membership record requirements.

6. Meta Platform Requirements

WBMPAF maintains official channels on Facebook, Instagram, and WhatsApp, and may integrate Meta APIs for messaging, forms, or verification services. To maintain Meta compliance:

  • Automated responses and messaging bots clearly identify WBMPAF as the sender.
  • Data-deletion requests arising from Meta surfaces are honored within 7 business days.
  • Broadcast messaging follows Meta’s opt-in rules; users may opt out through in-message commands or by contacting us.
  • Any integration using Meta APIs is subject to internal review and may be disconnected immediately if it violates Meta’s policies or Indian legal standards.

7. Liability & Indemnity

WBMPAF services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free access and are not liable for indirect, incidental, or consequential damages, except as required under law.

You agree to indemnify and hold WBMPAF, its officers, and representatives harmless against claims arising from:

  • Violation of these terms
  • Infringement of third-party rights
  • Misuse or unauthorized use of WBMPAF platforms

8. Governing Law & Dispute Resolution

  • These Terms of Service are governed by the laws of India.
  • Any disputes fall under the exclusive jurisdiction of the courts in Kolkata, West Bengal.
  • Wherever possible, WBMPAF will initiate internal grievance redressal before legal proceedings.
